During her university studies, Maître Cindy Diaz quickly turned to social law and its many facets. Determined to become a seasoned specialist in this field, she chose to complement her academic knowledge with varied professional experience at specialist law firms, employment courts (Conseil de Prud’hommes and Court of Appeal) and within companies (HR departments, accounting firms).

Employer side

  • Preparing to recruit an employee: handling procedures to obtain work permits for foreign employees, choosing the type of contract best suited to the situation, organising and monitoring the probationary period (duration, renewal, termination)
  • Drafting and amending employment contracts and their « sensitive » clauses: remuneration, working time (fixed-day/fixed-hour arrangements, multi-weekly, annual or multi-annual working time arrangements), mobility, exclusivity, non-competition, intellectual property
  • Drafting and monitoring part-time employment contracts and other « atypical » contracts (temporary work, fixed-term assignments, project-based work, subcontracting)
  • Organising employee representative elections (setting up/renewing the CSE works council) and managing collective disputes

  • Strategic support for employees leaving their employment contract: choosing the type of termination (mutually agreed termination, constructive dismissal, etc.) and timing, negotiating departure terms and severance payments
  • Optimising the social security and tax treatment of termination payments and settlement payments
  • Helping to establish specific and particularly difficult professional situations for the employee: harassment (psychological and sexual), workplace accidents and occupational illness, disability
  • Representation before all courts (Labour Court, Social Security Tribunal) and social security bodies (CPAM health insurance fund, CRA), for all disputes brought in the employee’s interest and to protect their rights
